Release and Hold Harmless Indemnification Agreement: 

 
I,________________________________________________________________(Hereinafter referred to as “Guest”) desire to engage in equine activities at 3952 SW 42nd Ave., Palm City, Florida 34990.Chuck & Caroline Havens and family (hereinafter referred to as “Property Owners”). Sunny Times Stables/Horse Haven Rescue INC./ Linda Sistarelli or any owners of Tu-Baud farms, property leased by or belonging to- and /or/ horses belonging to any boarders (Hereinafter are referred to as “Stables“).  
In consideration of being permitted by Property Owners to enter upon the premises and engage in equine activities, Guest for herself/himself and his/her minor children/child and other ward(s) does forever and formally release, remise, acquit, satisfy and forever discharge Property owners, their heirs, executors, administrators, representatives, agents, employees, attorneys assigns, athltales and successors and predecessors in interest of and from all manner of action, and actions, enuse and causes  of action, suit, debts, due sums of money, bonds, billings, contracts, coninwersies, agreements, promises, damages, variances, judgments, executions, claims and demands whatsoever, in law or equity, which may arise or might in the future arise hereinafter for and against Property Owners, agents , employees, stables, business owners and boarders, including, but not limited to claims for the acts of negligence of Property Owners, agents, employees, stables and boarders. For the purpose of this Release, “property damage” shall include damage of whatever nature of cause to property including horses or tack, owner by Property Owners, Guests, or Stables (boarders/horse owners) including but not limited to loss due to theft, fire, acts of nature or whatever the cause. This document is meant to be a full and complete Release from any and all liability that may arise from Guest engaging in activities on the property of Property Owners/ Stables. This Release is giving freely and voluntarily by Guest and is meant to remain in existence throughout the duration of present and future activities engaged in by Guest on the premises of Property Owners, Guest understands and acknowledges the damages and inherent risks associated with the activities, equine and otherwise, engaged in a rural community, and completely and knowingly assumes said risks. The undersigned understands and agrees that being on or around a horse stable is very risky and dangerous and injury can occur easily from a wide variety of situations and incidents. The undersigned understands and acknowledges that horses can bite, strike, kick, rear, stumble, fall, buck, and throw the rider, causing damage and injury, that dogs and cats or livestock can also bite, kick, or scratch and fight. The undersigned understands and acknowledges that you are responsible to supervise your children 100 percent of the time and in no way expects Sunny Time Stables/ Linda Sistarelli to provide supervision of any kind (except during camps). In further consideration of the right to engage in activities on the premises of Property Owners, Guest does further unconditional agree to indemnify and hold harmless Property Owners, their heirs, executors, administrators, personal representatives, agents, employees, attorneys, assigns, affiliates, and successors and predecessors, Stables, horses owners, Linda Sistarelli, Horse Haven rescue INC.& Sunny Time Stables, horse boarders in interest from any and all claims as enumerated above including but not limited to any demands, judgments, awards liabilities, costs, attorneys fees, or any other damages on account of any such actions or claims, including for personal injury or property damage, regardless of the source of said action or claims and including any claims resulting from negligence of Property Owners, Linda Sistarelli, Sunny Time Stables, employees, Stables, or agents. 
 
WARNING: UNDER FLORIDA LAW, AND EQUINE ACTIVITY SPONSOR OR EQUINE PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO, OR THE DEATH OF, A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE ACTIVITY. 
 
In the event an attorney is engaged to enforce, construe or defend any of the terms and conditions of this agreement, or to collect any payment due hereunder, either with or without suit. Guest agrees to pay all attorneys’ fees and cost occurred by Property Owners, Linda Sistarelli, Sunny Time Stables, Stables - Guest does hereby waive trail by jury and does further consent to the venue of any proceeding or lawsuit under this agreement to be Martin County, Florida. 
 
By signing below you are also allowing the possible use of photos that may be taken of your family. If you do NOT want your family to be photographed- please initial next this space, __________________ (no photos please!) 
 
I KNOWLEDGE THAT I AM 18 YEARS OR OLDER. I HAVE READ AND UNDERSTAND THE ABOVE AGREEMENT. I UNDERSTAND THE DANGERS OF HORSEBACK RIDING AND BEING AROUND A HORSE STABLE. I HAVE CHECKED ALL MY EQUIPMENT TO SEE THAT IT IS NOT DEFECTIVE IN ANY WAY AND I KNOWINGLY ACCEPT THE RISKS INVOLVED IN HORSE RELATED ACTIVITIES.
